For part performance to be sufficient; i. Such act of part performance must refer to the contract selected ii. The contract must be one specifically enforceable iii. There must be oral evidence to prove the terms of the contract iv. The act must be such that is was done by one party on the promise of the other party and as such, his position has been altered and it would be unjust for the other party not to be compelled to perform his own part.
