privity of contract

Q1047. Why is it that a person who was not a party to a contract cannot be allowed to benefit from same or bear the liabilities arising therefrom by the doctrine of privity of contract

A contract is not an omnibus that carries any passenger at any time but an agreement between parties who are ready to be bound by the terms thereof. To this end, any person who never took part in bringing a contract into existence cannot be conferred with the rights, obligations, and liabilities arising therefrom. See DUNLOP PNEUMATIC TYRES CO. LTD. v. SELFRIDGE & CO. LTD.
