Q695. Will this regulation also apply to those who have already installed electric fences before it’s (the regulation) coming into existence?

Yes. In fact, persons who have already installed electric fences are to re-apply and formalize their installations with the Discos and NERC as applicable.

Q696. What procedure must I follow to successfully install electric fence in my premises where the rate of theft and burglary has become alarming?

To successfully and lawfully install an electric fence, you must first obtain the consent of the distribution licensee, the Disco who is authorized by the Nigerian Electricity Regulatory Commission to supply electricity to the area where the proposed electricity fence installation is to take place. You will also need the consent of the Nigerian Electricity Regulatory Commission (NERC) where the electricity supply to the fence is both from public and from private generation. In your application to the distribution company in charge of your area, you must state the following;

i. The name of the applicant.

ii. Your contact address.

iii. The proposed location for the installation of the electricity fence.

iv. The site map showing the proposed location of the fence and its surrounding structure.

v. A signed undertaking to comply with the provisions of the Regulation on Electricity Fencing in the Nigeria Power Sector.

Q697. Will it be right to erect an electric fence along a public road?

Public roads are roads easily accessed by members of the public. At a glance, it would seem unsafe to erect an electric fence along public road. Erecting an electric fence along public road to secure a private or a protected area that is not open, in the ordinary course of public use of public space, for members of the public to go into, is not illegal and as long as the fence is installed according to legal regulations, and in such a way as to ensure that the electrified wire or articles cannot inadvertently come into contact with innocent passers-by. Furthermore, where the electric fence is to pass above or underneath a national road, then special permission must be sought and obtained.

Q698. What specific care must I take when erecting an electric fence in a public road?

When erecting or installing an electric fence in a public road, proper care should be taken so that the installation should not be done in a manner or way that would encourage obstruction. e.g obstruction by vegetation, shrubbery, creepers, trees, telephone poles etc. In urban areas, care should be taken so that no obstruction can in any way come closer than 1.0m sideways and 1.5m above the electric fence. In rural areas, it shall be 1.2m sideways and 1.5m above of the electric fence.

Q699. Where it is not possible to remove an obstruction, does this mean I won’t be allowed to install an electric fence?

No. where it becomes evident that it is impossible to remove an obstruction, then you must obtain a derogation form from the Nigerian Electricity Regulatory Commission (NERC) in order to successfully install your electric fence.

Q700. Considering how dangerous and lethal electricity may be when humans carelessly come in contact with it, what then is the requirement put in place to ensure that innocent and law abiding citizens do not get harmed, and also for environmental safety?

The following are the safety requirements that must be met:

i. The first requirement is that effective operation of electricity fences upon installation of electric security fences components must be ensured.

ii. Voltage impulse peak shall not exceed 10KV except in compliance with clause 4 of IEC 60335-2-76 standards. Also, energizer output must either be current or energy limited.

iii. Any injury or death caused by contact with the electricity fence must be reported to the distribution licensee and NERC within 24 hours of the incident.

iv. Only industry acceptable, purpose-made insulators shall be used on electric fence installations.

v. The installer shall only use earth rods which are made of conductive corrosive-resistant material and have a minimum length of 1 meter.

Q701. It is observed that there is an alarming rate of indiscriminate use of electric fences in Nigeria today. It appears that anyone who can afford it just gets up and installs it, with scant regards to public health and safety. Is there nobody charged with the responsibility of monitoring this dangerous surge?

The Nigerian Electricity Regulatory Commission (NERC) has the responsibility for monitory the installation, how it is used, and the maintenance of electric fences throughout the country to ensure that electricity and the installation of electricity fences is not misused.

Q702. Some persons erect electric fences without even caring to put up a Warning Sign that the fence is electrified. Is this proper and lawful?

It is not proper. It is unlawful to do so. All electric fences must be identified by prominently displayed Warning Signs that are fastened to the fence posts or to the conventional fence. Where the fence is located in an urban area, the warning sign must be displayed on each run of a straight length of the fence so that the sign are not further than 10m apart with a minimum of 2 signs on each straight length of the fence.

Q703. How proper is it to install an electric fence near communication lines?

It is not proper to do this because it could be very unsafe. However, this does not mean that it is illegal. Where an electric fence is installed and operated near communication lines, then adequate steps must be taken to prevent harmful interference on the nearby communication lines.

Q704. How proper is it to electrify “Barbed” or “Razor” wire by direct electric supply?

It is very improper to do this. In fact, it is prohibited. The regulation states clearly that barbed wire, razor wire and all metallic parts of the fence must not be electrified by direct electric supply or an energizer. It is prohibited.

Q706. Can I earth my electric fence energizer in the same earth system used by a communication provider?

No. the energizer cannot be earthed to the same earth systems as used by the communication provider or by the local electricity supplier or both. There must be distance between the earth system of the energizer and that of the communication provider and the distance cannot be less than 2 meters.

Q707. For the purpose of installing my electric fence, will it be safe to install the electricity fence energizer close to the vicinity of power?

An energizer is a device which converts electric power into brief high voltage pulse. Although it is non-lethal, it nevertheless has an unpleasant effect ranging from uncomfortable to painful. As a result, it is every unsafe to install an energizer in close vicinity of power. An electric fence energizer must be installed as close to the fence as possible and also in a secured location within the premises of the fence owner.

Q708. Can I use more than one energizer for installation of an electric fence?

Yes. However, where 2 or more energizers are connected to an electric fence, the operation of the energizer must be coordinated in such a way as to ensure effective pulses on any conductor of the fence as defined by the limits of any compliant single energizer. Regulation 17 of the Draft of the proposed Regulation on Electric Fencing in the Nigerian Power Sector 2015

Q709. What likely resolution will the NERC take when communication line interference persists, in spite of adequate preventive and protective measures taken?

Where the electricity fence installation and the communication lines comply with standards and yet line interference persists, the owner of the electric fence will be required to reconfigure his fence. If this does not solve the problems, then the electric fence shall be switched off or removed.
